Fund My Staff ("Company", "We", "Our", or "Us") operates the website fundmystaff.comand the mobile application ("Fund My Staff"), collectively referred to as the "Platform(s)".
Through the Platform, We may offer credit services in collaboration with lending partners and other commercial partners. By using the Platform or Services, You agree to these Terms and Conditions ("Terms") together with any specific terms that apply to the relevant Service.
Please read these Terms carefully before registering, accessing, browsing, downloading, or using the Platform or any Service. If You do not agree, please stop using the Service.
1. Interpretation and Definitions
Capitalized words have the meanings set out below and apply to both singular and plural usage.
- Affiliate: An entity that controls, is controlled by, or is under common control with a party.
- Country: Delhi, India.
- Company: Fund My Staff.
- Device: Any device capable of accessing the Service.
- Service: The website, app, and related services.
- Terms: These Terms and Conditions.
- Third-party Social Media Service: Third-party services or content available through the Service.
- Website: Fund My Staff.
- You: The individual, company, or entity using the Service.
2. Acceptance
- These Terms govern the use of the Service.
- Your access and use of the Service are subject to Your acceptance.
- By accessing or using the Service, You agree to be bound by these Terms.
- If You disagree with any part of these Terms, You must stop using the Service.
- You must be 18 years or older to use the Service.
- Your access is also subject to our Privacy Policy.
3. User's Representations
- You are 18 years of age or older.
- You are capable of entering into a legally binding agreement.
- You are not barred or legally prohibited from accessing the Platform or Services.
- You are an Indian national and a tax resident of India.
4. User's Undertakings
- Do not violate the Agreement or any applicable law.
- Do not use the Services with illegally obtained funds.
- Do not infringe any intellectual property, publicity, or privacy rights.
- Do not post content that is defamatory, false, unlawful, or harmful.
- Do not refuse to cooperate in identity verification or investigations.
- Do not damage, disable, overburden, or impair the Platform.
- Do not use robots, spiders, or similar tools to copy or monitor the Platform.
- Do not distribute viruses, malicious code, or offensive content.
5. Use of Platform and Availing of Services
Until You accept and comply with these Terms, Fund My Staff grants You a personal, non-exclusive, non-transferable, limited, revocable privilege to access and use the Platform and Services. Additional service-specific conditions may apply.
6. Registration and Account Data Confidentiality
Access to the Platform may require registration and OTP-based authentication. You must provide correct, complete, and current information and keep Your login details confidential.
We may request additional information for identity verification. You may only have one account unless Fund My Staff permits otherwise in writing.
7. Partner Services and Payments
Services made available through lending partners or commercial partners are provided on an as-is and as-available basis. Fund My Staff acts as an intermediary/facilitator and is not responsible for partner-side failures, technical errors, or disputes.
Payment mechanics for each Service will be shown in the relevant flow.
8. KYC, Communications, and Territorial Restrictions
Some Services may require KYC information and supporting documents. Fund My Staff may contact You by SMS, email, WhatsApp, push notifications, or similar channels. Territorial restrictions, if any, will be shown in the relevant Service terms.
9. Suspension, Termination, and Consequence
We may suspend or terminate access if We find inaccurate information, security concerns, misuse, or a breach of these Terms. Ending use of the Platform does not cancel obligations already created under a separate agreement.
If Your access is suspended or terminated, You remain liable for all amounts due under any active Service or partner agreement.
10. Personal Information and Fees
Personal information is handled according to our Privacy Policy. Any fee, charge, or repayment instruction will be shown before You complete the relevant action.
11. Credit Facilities Related Services
Process for availing Cash loans
Based on Your credit information and partner criteria, Fund My Staff may show loan offerings. The journey may include KYC verification, liveliness or video KYC, auto-debit mandate creation, and OTP-based execution of loan documents.
Cancellation of Loan
A loan may be declined at any stage of the journey by the relevant lending partner. No User is assured of a loan.
Key Fact Statement
A Key Facts Statement may be shown with the principal amount, EMI, APR, total interest, penal charges, recovery mechanism, grievance details, and cooling-off/look-up period.
Reporting of Credit Line Sanctioned
After KYC and sanction, the lending partner may report the credit line to relevant credit bureaus as required by law.
Recovery Agents
In case of default, details of third parties engaged for collection may be communicated to the User as required by law.
Sharing of User's PAN Details
Fund My Staff may store and share PAN details with lending partners where needed for the service.
Borrower's Covenants
- The loan will be repaid via EMIs and auto-pay mandates may be used.
- Each EMI must be paid on or before the due date.
- Non-payment may trigger default, additional charges, and credit impact.
- Recovery contact may happen by phone, in person, or otherwise as permitted by law.
- Pre-payment may be allowed subject to the loan documents.
Other important features
- Signed loan documents may be sent by email along with the KFS.
- You may be able to close a loan within three days of disbursal without penalty, subject to the applicable flow and support process.
Information and Grievance Redressal
Information related to the loan is available on the Platform. If You need further help or want to raise a grievance, contact our support team at contact@fundmystaff.com.
12. Promotional Offers and Disclaimers
You may receive promotional offers, marketing materials, and service updates through calls, email, SMS, WhatsApp, or other electronic means. Fund My Staff is a technology platform and is not the lender unless a separate written agreement says otherwise.
Third-party links are provided for convenience. Fund My Staff is not responsible for third-party content, quality, or outcomes.
13. Limitation of Liability, Indemnity, and Tax Liability
Services are provided on an as-is and as-available basis. To the maximum extent allowed by law, Fund My Staff is not liable for indirect, incidental, punitive, or consequential damages. The total cumulative liability is capped at INR 10,000, except where law requires otherwise.
You agree to indemnify Fund My Staff and its partners against claims arising from misuse of the Platform, breach of these Terms, or violation of law. You are responsible for applicable taxes related to Your use of the Services.
14. Intellectual Property and Governing Law
Fund My Staff owns the intellectual property in the Platform and content, except for third-party content and links. These Terms are governed by the laws of India, and disputes will first be attempted to be resolved informally before arbitration or other lawful dispute resolution as applicable.
